Acceptance and Responsibility

Please take the time to read these terms and conditions before booking your stay with Sugarloaf Wilderness Retreat.

Payment of the booking price constitutes acceptance of these Terms and Conditions. By booking with us, you agree to accept, without limitation, all of these terms and conditions of use.

All bookings made are subject to these terms and conditions and the person making the booking is deemed to have accepted these terms and conditions on behalf of all the individuals staying at Sugarloaf Wilderness Retreat.

Sugarloaf Wilderness Retreat has the right to change or update these terms and conditions without prior notice by posting amended terms on our website.

Sugarloaf Wilderness Retreat, Charbot PTY LTD and the owners of the property (Eric and Claire Chabot) accept no responsibility from all claims or causes of action you or any guests may have (including for negligence) arising from any injury, loss or damage of any kind suffered by the guests including personal injury, illness or death and/or loss or damage to any property (in so far as this does not breach the provisions of the relevant Australian Consumer Law) arising either directly or indirectly out of your stay at the property.

Cancellation Policy

As a small business, in order to pay overheads we must maximise our occupancy. Cancellations often result in loss of revenue due to vacancies and the average booking lead time needed to resell the accommodation. 

Please contact us immediately if you wish to vary or cancel your booking. All cancellations must be received via email from the email address linked to the reservation.

We strongly suggest you get travel insurance to cover unexpected cancellations due to travel delays, natural disasters, pandemics, health problems and other unforeseen circumstances.

We will do our best to work with you regarding cancellations and change of dates, however, at the end of the day if accommodation can not be resold, as a small business your misfortune can not also become our misfortune.          

Credit Cards Offer Travel Insurance: Many credit cards offer free travel insurance when accommodation, flights and tours are booked on the card - check with your credit card provider for details.

Domestic Travellers: Domestic travel insurance starts at $100 per year and covers for an entire year all domestic airfares, accommodations, tours and more.

International Travellers: If you are an international traveller it is negligent [sorry] on your end to not have travel insurance in place. 

Normal Cancellation Policy

For cancellations with 14 days or more notice prior to arrival date, the full amount paid will be refunded less a $40 admin fee .

For cancellations within 8-14 days of your arrival date, 50% of the full amount paid will be refunded less a $40 admin fee 

For cancellations within 7 days of your arrival date, no cancellation is accepted and you will be charged for the total 100% of your reserved stay. If management is able to resell the accommodation for the period cancelled a further refund may be made less administration charges, commissions and expenses.

No refund can be given in the event of non-arrival, any unused services or unused nights due to flight / weather disruption.

Peak Season Cancellation Policy

Bookings for July, August, Easter and the Christmas/New Year holiday period require 30 days’ notice of cancellation or all monies will be forfeited. Outside that period a full refund will be given minus a $40 admin fee.

In the event of pandemics and natural disasters affecting the Snowy Mountains Region which prevent you from travelling to our area you will receive a free change of date or gift voucher valid for two years. Unfortunately if this isn't possible or doesn't work for you then you will have to claim the loss on travel insurance.

We understand that travellers to our destination generally travel a long way, have planned the trip and often stay with us for special occasions. If for some reason we can not accommodate you last minute [within 14 days of arrival or 30 days in peak seasons] due to maintenance issues you will receive a refund in full plus a free future stay. 

 

Location

Our accommodation sites are located on rural and often undeveloped areas of land that may not be staffed 24/7. As such all guests acknowledge that it is their responsibility to maintain their own safety in and around our accommodation and property.

You acknowledge that you are aware of the risks entailed in the remote rural environment (including but not limited to spiders, wombat holes, snakes, hot summer temperatures, cold temperatures in winter, windy conditions, unexpected bushfires and smoke, snow and icy conditions, hail, thunder and lightning, high escarpments) and the low-light environment at night that is preserved for the benefit of animal spotting and stargazing.

 

Check-In

Check-in is from 2pm. In order to offer guests the best experience, please arrive well before sunset if possible. Some of our accommodation is set in dark and remote corners of our property [for your privacy] which as a result can be hard to navigate for first time visitors. Earlier check-ins are subject to availability - by all means contact us via email to request earlier check-in.

Check-Out 

Before departure, all rubbish must be put in the appropriate rubbish bins provided outside the accommodation. The Property must be left in a clean and tidy condition. If the BBQ, fireplace and fire-pit has been utilised please ensure it has been left in a reasonable state.  If accommodation is left excessively dirty or messy and requires excess cleaning then your card on file will be charged at a minimum $200 excess cleaning fee.  

Payment

You must pay the full amount of your stay before the booking will be confirmed.

You agree to not bring any more people than your accommodation has been booked for [most sites are two people max] as this is in breach of our fire code regulation, council holiday letting approval and insurance indemnity. Only those persons indicated on the booking form may enter the accommodation and use the property [day visitors must be reported to management]. 

Sugarloaf Wilderness Retreat reserves the right to request additional guests to leave if this is not adhered to; and in extreme circumstances may evict you from the property without a refund. Sugarloaf Wilderness Retreat reserves the right to either:

  • request additional guests to leave and pay a fee of minimum $250 per person per night;
  • request all guests to leave without a refund and pay a fee of minimum $250 per person per night.

No Pets Allowed

Being animal lovers we would love to have your pets stay with us, however due to the close proximity of native wildlife, our own animals and the quietude of other guests, no pets are allowed on the property. If guests are found to have a pet or there is evidence of a pet being on the premises, Sugarloaf Wilderness Retreat reserves the right to either:

  • request guests to remove the pet immediately and pay a cleaning fee of minimum $250;
  • request guests to leave without a refund and pay a cleaning fee of minimum $250

Security Bond

A credit card authorisation of $500 must be provided to Sugarloaf Wilderness Retreat upon confirmation of your booking. Any damage loss or expense incurred to Sugarloaf Wilderness Retreat will be charged against the credit card. Examples include but are not limited to any breakage, damage or excess cleaning requirements, or extra guests beyond those declared.

Smoking Restrictions

Smoking is not permitted inside any accommodation or within 3 metres of buildings. Breach of this condition may result in immediate termination and eviction. If there is evidence of smoking inside than an additional $300 fee will be charged to your credit card.

Visitors

Sugarloaf Wilderness Retreat is a guests only property. We request that no visitors be brought or invited to the property unless by prior arrangement with management. Breach of this condition may result in immediate termination and eviction.

Food, Beverages + Extra's

Where guests purchase food, beverages or extras prior/during their stay, the price will be charged to their accommodation for full payment through the guaranteed credit card.

Vehicles

While all efforts are made to keep the roads suitable for all-weather driving, no responsibility is taken for loss or damage to vehicles including but not limited to rocks or debris on the road, uneven surfaces, exposed rocks, wildlife or washed road surfaces.

Personal Loss

Sugarloaf Wilderness Retreat strongly recommends that at the time of booking you purchase comprehensive travel insurance to cover items including but not limited to: loss of booking amount through cancellation, loss or damage to personal baggage, loss of money and medical expenses.

When staying at Sugarloaf Wilderness Retreat, please keep all valuables and belongings safe by locking your doors and using the safe provided in your accommodation. In the event that your personal possessions are lost, stolen, damaged or misplaced on the premises, Sugarloaf Wilderness Retreat does not assume financial responsibility.

Shut The Gate 

All paddocks on the property usually contain animals. Please always remember to shut all gates that you opened.

Campfires

Campfires must only be lit in the designated areas, and subject to suitable weather conditions, fire bans and any directions from management.

Private Information

You consent and authorise Sugarloaf Wilderness Retreat to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.

Sugarloaf Wilderness Retreat will not provide or disclose any information you have provided to Sugarloaf Wilderness Retreat to any person without your prior written consent, except to the extent required to administer your booking and providing you with any services associated with your booking.

Upon request and to the extent permitted or required by law, Sugarloaf Wilderness Retreat will provide an individual with access to and/or the ability to correct their personal information held by Sugarloaf Wilderness Retreat

Indemnity and Limitation of Liability

To the extent permitted by the law, you agree to release, indemnify and hold harmless, Sugarloaf Wilderness Retreat and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at the property except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from Sugarloaf Wilderness Retreat's negligence, wrongful act/omission or breach of these terms and conditions.

 

Australian Consumer Law

To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Faraway Domes are excluded under these terms and conditions.

Nothing contained in these terms and conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Faraway Domes to limit its liability, then Faraway Domes' liability is limited to:

  • in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
  • in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

Miscellaneous

These terms and conditions are governed by and will be construed in accordance with the laws of New South Wales.

If part or all of any clause of these terms and conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these terms and conditions and the remaining provisions of these terms and conditions will continue to have full force and effect.

 

Variations

A variation of the booking which reduces the number of nights stay will be a treated as a cancellation of the booking in respect of those nights. We have a minimum nights' stay policy of 2 nights. No refund will be made for a variation to the extent that it breaches our minimum nights’ stay policy. Rates are subject to change without notice.

Bookings may be transferred to another guest only with managements prior written approval and the payment of a $40 variation fee.
